Terms of Service

1. Agreement to these Terms

By accessing or using Keimodel ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of the Service

Keimodel is an AI model comparison platform that lets users run prompts against multiple large language models simultaneously and compare responses side-by-side. The Service also provides benchmark data, model directories, and educational content about AI models.

3. Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction, whichever is higher) to use the Service. By using the Service you represent that you meet this requirement.

4. Account registration

Some features require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at hello@keimodel.com if you suspect unauthorised access.

5. Credits and billing

• Credits are purchased via Stripe and applied to your account balance upon successful payment.
• Credits are consumed when you run prompts through paid models. Free models do not consume credits.
• Credits are non-refundable except where required by applicable law.
• We reserve the right to change credit prices and costs with reasonable notice.
• If you believe a charge is in error, contact us within 30 days of the transaction.

6. Acceptable use

You agree not to use the Service to:

• Generate content that is illegal, harmful, abusive, or violates the rights of others
• Attempt to bypass rate limits, credit controls, or authentication
• Scrape, crawl, or automate requests in a way that places unreasonable load on the service
• Reverse-engineer, decompile, or otherwise attempt to extract the source code
• Resell or redistribute API access without prior written permission
• Submit prompts designed to extract or misuse training data from third-party models

We reserve the right to suspend or terminate accounts that violate these rules.

7. Intellectual property

The Service, including its design, code, benchmark data, and editorial content, is owned by Keimodel and protected by intellectual property law. You retain ownership of any prompts you submit. By submitting prompts, you grant us a limited, non-exclusive licence to process them for the purpose of delivering the Service.

8. Third-party model providers

Model responses are generated by third-party providers (OpenAI, Anthropic, Google, etc.) under their own terms and policies. We do not control their output, are not responsible for its accuracy, and make no warranty that it is suitable for any particular purpose.

9. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

10. Limitation of liability

To the maximum extent permitted by applicable law, Keimodel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our aggregate liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your access at any time for violation of these Terms, or for any other reason with reasonable notice. You may delete your account at any time. On termination, unused credits are forfeited unless applicable law requires otherwise.

12. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by updating the effective date above and, where practicable, by email. Continued use of the Service after a change constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Delaware.
